Directive explained

What an Article 9 report contains

Last reviewed 2026-10-16

The gender pay gap figures Article 9 lists: mean and median gaps, variable components, quartiles, and the gap by category of workers.

Article 9

The listed information

Article 9(1) lists the information employers in scope provide: the gender pay gap; the gender pay gap in complementary or variable components; the median gender pay gap; the median gender pay gap in complementary or variable components; the proportion of female and male workers receiving complementary or variable components; the proportion of female and male workers in each quartile pay band; and the gender pay gap between workers by categories of workers, broken down by ordinary basic wage or salary and by complementary or variable components.

How it is shared

Member States make the information public. Workers, their representatives, labour inspectorates and equality bodies can ask for clarifications of the data, including explanations of gender pay differences. The employer answers with a substantiated reply within a reasonable time. Where differences are not justified by objective gender-neutral criteria, the employer remedies the situation within a reasonable period in cooperation with workers’ representatives, the labour inspectorate and/or the equality body.

The public calculator

The free calculator computes a mean gap, a median gap, quartile shares, and a flag when a gap is at least 5%, on figures that stay in the browser. It is an illustration of those measures. It is not an Article 9 file, it does not break results down by category of workers, and it does not send data to a Member State.
