Remedies and penalties
Last reviewed 2026-10-16
The Directive requires compensation and effective penalties. It does not set fine amounts. Amounts, if any, are national.
Article 16 · Article 23
Compensation
Article 16 requires Member States to ensure that workers who have sustained damage as a result of an infringement of a right or obligation related to equal pay can claim full compensation or reparation. The Directive does not set the amount. A national cap or formula, if one exists, is national law and is not restated here.
Penalties
Article 23 requires Member States to lay down rules on penalties for infringements of national provisions adopted under the Directive. Those penalties must be effective, proportionate and dissuasive. The Directive does not publish a fine table. This site does not quote a fine that a Member State has not been cited for on the country page.
